Economic Damages
Economic damages, also known as “special damages,” compensate victims for measurable financial losses resulting from the accident. These damages are tangible and can be backed up with documentation, such as receipts, medical bills, and pay stubs.
1. Medical Expenses
One of the largest components of economic damages is medical costs. This includes expenses related to emergency care, hospital stays, surgeries, medications, physical therapy, and long-term treatment, if needed. Even future medical expenses, such as ongoing rehabilitation or specialized care, can be included in your claim.
Example: If you required surgery after a collision or anticipate needing physical therapy for the next six months, these expenses are factored into your claim.
2. Lost Wages
If your injuries prevent you from working, either temporarily or permanently, you may recover lost wages as part of your economic damages. This can include any income you’ve already lost, as well as anticipated future earnings if your ability to work has been diminished.
Example: Suppose the accident caused a spinal injury that forced you to miss six months of work. Your claim can include those six months of lost salary, plus any potential income lost if you’re unable to return to your former position.
3. Property Damage
Accidents involving 18-wheelers can cause extensive damage to smaller vehicles. Victims can recover the cost of repairing or replacing their car, as well as reimbursement for items inside the vehicle that may have been destroyed.
Example: If your vehicle was totaled in the accident, the replacement value of your car can be included in your claim.
